By accessing or using HeadStudio.ai ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

HeadStudio.ai is an AI-powered service that transforms user-uploaded photos into professional headshots using artificial intelligence technology.

3. User Accounts and Payments

3.1. You are responsible for providing accurate information when using our Service, including your email address for delivery of your AI-generated headshots.

3.2. Payment for the Service is processed through Stripe. By making a payment, you agree to Stripe's terms of service.

3.3. All payments are non-refundable except as provided in our satisfaction guarantee (see Section 7).

4. User Content and Rights

4.1. By uploading photos to our Service, you grant us a limited license to use, modify, and process these images solely for the purpose of generating AI headshots for you.

4.2. You represent and warrant that you own or have the necessary rights to the photos you upload, and that these photos do not violate any third party's rights.

4.3. We do not claim ownership of your uploaded photos. Your original photos will be deleted from our servers 30 days after processing.

4.4. You retain all rights to the AI-generated headshots we create for you. You may use these headshots for personal and commercial purposes.

5. Prohibited Uses

You agree not to use the Service to:

• Upload photos of individuals without their consent
• Upload photos of minors
• Upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Attempt to reverse-engineer or extract the AI models or technology used by the Service
• Use the Service in any way that could damage, disable, or impair the Service

6. Intellectual Property

6.1. The Service, including its design, features, and functionality, is owned by HeadStudio.ai and is protected by copyright, trademark, and other intellectual property laws.

6.2. You may not copy, modify, distribute, sell, or lease any part of the Service without our explicit permission.

7. Satisfaction Guarantee

7.1. We offer a 100% satisfaction guarantee. If you are not satisfied with your AI-generated headshots, you may request a refund within 7 days of receiving your headshots.

7.2. Alternatively, we may offer to regenerate your headshots at no additional cost.

7.3. To request a refund or regeneration, please contact our support team at support@headstudio.ai.

8. Limitation of Liability

8.1. The Service is provided "as is" without warranties of any kind, either express or implied.

8.2. In no event shall HeadStudio.ai be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of the Service.

8.3. Our total liability for any claims under these Terms shall not exceed the amount you paid for the Service.

9. Indemnification

You agree to indemnify and hold HeadStudio.ai harmless from any claims, damages, liabilities, costs, or expenses (including attorney fees) arising from your use of the Service or violation of these Terms.

10. Modifications to the Service and Terms

10.1. We reserve the right to modify or discontinue the Service at any time without notice.

10.2. We may update these Terms from time to time. Continued use of the Service after any changes constitutes your acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
